Assumption of Risk, Waiver of Liability and Photo Permission

Liability Waiver: In consideration of voluntary participation in this event I hereby acknowledge that I understand that there are risks of accidents resulting in bodily harm to me arising out of this activity. I further acknowledge that I have the physical capacity reasonably necessary to engage in this event. I hereby, for myself, my heirs, executor, assigns and personal representatives, forever waive and release any and all rights and claims for damages I now or may hereafter have, whether known or unknown, the Columbia Slough Watershed Council (CSWC), the City of Portland or any of their officers, agents, employees, volunteers, or co-sponsoring organizations or individuals, for any injuries suffered in connection with or arising out of participation in said activity.

Photo Permission: I hereby grant permission to  the CSWC the rights of images of myself, my children and my property, likeness and sound of our voices as recorded on photographs, audio or videotape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed in print or electronically and waive the right to inspect or approve the finished product. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.

COVID-19 Waiver: I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by participating in an event through the CSWC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. The CSWC cannot guarantee that my child(ren) and I will not become infected with COVID-19. Furthermore, attending any event hosted by the CSWC could increase your risk and your child(ren)’s risk of contracting COVID-19.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at or participation in the CSWC’s programming. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the CSWC, its employees, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating there to. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the CSWC, its employees, agents, and representatives.
